The Patent Agent will lead and support all patent activity within Mohawks Flooring North America Segment- Soft Surface division. The Legal Department and Patent team are at the forefront of protecting Mohawks freedom to operate in today’s innovative and competitive flooring market. This role will manage Mohawks patent portfolio, build and strengthen our patent defensive position, drive due diligence on patent acquisitions and licensing, and engage with Mohawks businesses on emerging technologies. This role will have responsibility for all aspects of patents; i.e. not only the drafting and prosecution up to grant of the patent, but every aspect before the drafting (invention harvesting, informing R&D about competitor’s patent activities, study freedom to operate), and everything after the grant (invalidity attacks both offensive and defensive, license, etc.).
Responsible for the registration of patents and to define a strategy for protecting innovative ideas.
Partner with legal and product development teams to obtain all relevant information for proper filing.
Analyze invention disclosures to determine if sufficient information is available to support a claim to the invention.
Conduct patent database searches to determine whether potential prior innovations exist and assess the novelty and specialization of the invention such that a patentability opinion may be written and/or to prosecute patent applications as needed.
Ability to work closely with our R&D team to harvest inventions and inform them about competitor patenting activities.
Manage personal docket of all active patents.
Assemble literature references for information disclosure statements that are submitted to the PTO.
Will format nucleic acid sequences, draw chemical, electrical or mechanical specifications for submission to PTO when needed and according to their specific specialty.
Assist supervisory patent attorney in determining the inventor(s).
Write any necessary documents arising during patent prosecution (i.e., preliminary amendments, amendments/responses to Office Actions, appeal briefs, petitions, certificates of correction, reexams, reissues, etc.)
Conduct research to stay up to date with patents filed by competitors or otherwise interesting for the business.
Identify possible patent infringements and assist with identifying creative ‘design-around’ solutions.
Involvement in the commercialization of intellectual property through a licensing program.
Work with Mohawk in an international context to support our US soft surface division.
This position will be based out of our Corporate office in NWGA but will work directly under our Belgian & European Patent Attorney who is based out of Belgium. Additionally, this person will have a dotted line reporting structure to our FNA and Corporate Global Deputy General Counsel.
Perform special projects as assigned.
BA of Engineering; preferably in Textile, Mechanical or Chemical Engineering. MS preferred.
Registered as a US Patent Practitioner as provided for under USC 37 CFR §§ 11.5.
5+ years of patent practicing experience required; Flooring industry background a plus.
Ability to travel within the US our plants/facilities as well as internationally.
Impeccable written and oral communication skills, including ability to work effectively with various departments and levels.
Ability to manage multiple and competing priorities.
Demonstrated ability to contribute immediately in a challenging and fast-paced environment.
Keen attention to detail.
Unquestioned discretion handling confidential information.
Strong process and knowledge management skills.
